Bordertown Supply Co – Terms of Service and Purchasing Policies

1. Customer-Supplied Artwork and Licensing Liability
Whenever you submit images, logos, graphics, or concepts for a custom order, you guarantee that you have the legal right to use them. Bordertown Supply Co does not police or verify trademark or copyright ownership for customer-submitted designs. If a third party brings a legal claim against Bordertown Supply Co regarding the unauthorized use of your provided artwork, you agree to take full responsibility and cover all associated legal costs, damages, and claims (indemnification). We hold zero liability for copyright infringement resulting from customer requests.

2. Tooling Retention and Artwork Ownership

To maintain strict quality control over your custom products and future runs, Bordertown Supply Co retains ownership of all physical production molds (die molds) and original artwork files.
  • Molds: We will keep your custom molds on file for twenty-four (24) months following your most recent production run. If a reorder is placed after this 2-year window, a new setup/mold fee will apply to recreate the tooling. Molds may only be used for orders authorized by you or your designated representative.
  • Artwork: Any design work created or polished by Bordertown Supply Co remains our intellectual property. It cannot be taken to other manufacturers or used commercially without our consent. If you wish to purchase the exclusive rights to the artwork, you may do so by paying an artwork release fee of up to $300.
  • Website Content: The Bordertown Supply Co logo, website design, and branded assets are protected by copyright and may not be reproduced without written permission.

3. Billing, Cancellations, and Refund Policy

 Because custom manufacturing is tailored specifically to your needs, 100% of the invoice must be paid upfront before any production begins.
  • Custom Cancellations: If you cancel your order after production has started but before the physical molds are cast, we will refund 75% of your total invoice. Once the molding process is complete, the order is strictly non-refundable.
  • Design Changes: Alterations requested after you have given final approval may result in additional charges, or may be denied entirely if production is already underway.
  • Retail Items: All non-custom, standard merchandise sold by Bordertown Supply Co is considered final sale and non-refundable.

4. Proof Approvals, Errors, and Marketing Use

Production will only be scheduled after we receive your final, written approval on the digital proof (verifying layout, spelling, colors, and dimensions).
  • Errors: If a finished product contains a defect or error that differs from your approved proof, and the fault lies with Bordertown Supply Co, we will remake the affected items at no cost to you.
  • Marketing & Overruns: We reserve the right to use physical samples of your custom order for our portfolio, photography, and marketing materials. Additionally, we may sell or distribute any production overruns, misprints, or factory seconds through our own channels.

5. Production Lead Times

Any turnaround times quoted by our team are strictly estimates. While we strive to meet all targets, production can be impacted by delayed customer approvals, raw material shortages, or shipping bottlenecks. Bordertown Supply Co is not financially liable for missed deadlines unless a firm, guaranteed delivery date was explicitly agreed upon in a written contract prior to payment.

6. Shipping and Transit Liability

Once your order is handed over to the shipping carrier, the risk of loss, theft, or damage transfers entirely to the buyer. Bordertown Supply Co is not responsible for transit delays or mishandled packages. If you would like to protect your investment, shipping insurance can be added to your invoice upon request at your expense.

7. Manufacturing Tolerances

Due to the nature of physical manufacturing and differences in screen calibrations, the colors you see on your digital proof may vary slightly from the final physical product. Minor shifts in color matching, material texture, and exact sizing are standard industry variances and do not qualify as defects or grounds for a remake.

8. Order Minimums and Future Pricing

All custom merchandise requires a minimum order quantity (MOQ) of 50 units. Please note that pricing is subject to change. If you place a reorder in the future, particularly for a different quantity than your original run, the per-unit cost may differ. We will always quote you the current pricing before moving forward.

9. Customer-Provided Physical Materials

If you mail us physical items to use as references, templates, or raw materials for your project, you do so at your own risk. Bordertown Supply Co assumes no liability for the loss, alteration, or damage of these items while in our possession or during transit.

10. Force Majeure (Unforeseen Events)

Bordertown Supply Co cannot be held in breach of contract for any delays or failures in production caused by extreme circumstances outside of our control. This includes, but is not limited to, natural disasters, severe weather, global pandemics, strikes, supply chain collapses, acts of war, or government-mandated shutdowns.
